These terms apply when you buy or use a ParcelKite license from www.parcelkite.com (“we”, “us”). www.parcelkite.com is operated by Varity Ventures, 2453 Coho Way, Oakville, Ontario, L6M0G7, Canada. By placing an order or starting a free trial you agree to these terms.
1. What you buy
ParcelKite is a WordPress plugin for WooCommerce. A license gives you a license key that, while it is active, turns on the plugin’s licensed features (automatic tracking, shipment emails, SMS, PayPal sync), plugin updates and support, on any number of sites. Each plan includes a number of tracked parcels per month: each new parcel the plugin follows automatically counts once, in the month it starts. When they are used up, new parcels keep their carrier tracking link and are followed from the next month or after an upgrade.
The plugin’s code is free software licensed under the GNU General Public License (GPL) version 3. Nothing in these terms limits the rights the GPL gives you. These terms cover the license key, the services connected to it, updates and support.
2. Plans, renewals and free trials
- The price, the number of sites and the license period are shown on the plan when you buy it.
- Plans that renew are renewed and charged automatically at the end of each period until you cancel. You can cancel at any time under My account; the license then stays active until the end of the period you paid for.
- A free trial is limited to one per person and store. When it ends, the licensed features pause unless you buy a plan; you keep the same key.
- When a license expires, the licensed features pause. Tracking numbers, order statuses and your settings keep working.
3. Prices, payment and taxes
Prices are shown in the currency of the checkout. Sales taxes (for example GST/HST, PST or VAT) are added where they apply and shown before you pay. Payments are processed by our payment providers; we do not store your card details.
4. Refunds
See our refund policy. Your statutory consumer rights are not affected.
5. Your use of the plugin
- Keep your license key private. You are responsible for the sites it is activated on.
- Do not use the plugin or its tracking features to send unlawful, misleading or unsolicited messages, or in breach of your customers’ privacy rights.
- You are responsible for your store’s privacy policy and for having the consent required to send emails and text messages to your customers.
6. Third-party services
Automatic tracking runs on ParcelKite Cloud, which uses public tracking services of third parties (such as Cainiao and CJPacket). Other features use, if you set them up, services such as Twilio and PayPal. These services are not operated by us, are not official APIs in every case, and may change, limit or stop their service at any time. We do our best to keep tracking working but cannot guarantee that any third-party service is available or accurate. Carrier names and trademarks belong to their owners and are used only to describe compatibility.
7. Support and updates
While your license is active we provide plugin updates and email support for the plugin’s documented features. Support does not include custom development or problems caused by other plugins, themes or your hosting, although we will tell you what we find.
8. Warranty and liability
The plugin and our services are provided “as is”. To the extent permitted by law, we do not warrant that they will be uninterrupted or error-free, and we are not liable for indirect, incidental or consequential losses such as lost profits, lost data or the actions of carriers and other third parties. Our total liability for any claim is limited to the amount you paid for the license in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law.
9. Changes
We may update these terms. The version in force when you place an order applies to that order; changes for renewals are announced by email at least 30 days in advance.
10. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction. This does not deprive consumers of the protection of the mandatory laws and courts of the place where they live.
